TERMS & CONDITIONS
- These terms and conditions (these “Terms”) apply to your participation in the “Artiste First Finds” contest (the “Contest”). Please read these Terms carefully before entering the Contest. By participating, you hereby provide your consent to all the Terms herein. If you wish to disagree with any terms set forth, then you may not participate in the Contest.
- Only original tracks will be evaluated. Cover versions and/or tracks which are not owned by the Artiste are strictly prohibited.
- Singers, Music Composers, Music producers, Audio Engineers, Video Directors and Lyricists all can join the Discord community to collaborate with like-minded Artistes.
- Songs of all languages are allowed.
- Submissions across all genres are welcomed
- Both bands and solo artistes can only submit their original songs.
- One artiste/Band can send multiple songs.
- To submit multiples entries artistes would have to fill the form again.
- Artistes can also submit scratch audio or incomplete songs.
- Artistes can send their already released songs. But, the songs should be independently released, not with a label. All intellectual property rights in the submitted songs must vest exclusively with the artiste.
- Artistes are required to submit an audio file of the song such as SoundCloud, Google Drive, etc.
- For the artistes who have already released the songs, they can send the YouTube link or the link of any other streaming platform where the songs have been uploaded.
- By submitting their entry, artistes agree that they will not share the respective songs with any other music label or distributor from the date of submission until the results are announced.
- There is no entry fee for entering the contest and no purchase necessary to enter this contest.
- Submissions that are found to be duplicates of another person's submission will be disqualified at our discretion.
- Once the submission has been selected by us, the artiste forfeits his/her right to withdraw the submission. We will not be responsible for any unauthorized leaks or misuse of the submitted content/songs and will not be held liable for any damages or losses arising from such unauthorized leaks or misuse.
- You represent and warrant that: - (a) you are an adult and have attained the age of majority under the laws of your jurisdiction and have the legal right and power to enter the contest; (b) the submitted content and the use thereof in accordance with these terms will not violate any law or infringe upon the rights of any third party (including, without limitation, copyrights, trademark rights and rights of publicity and privacy); and (c) there are no disputes concerning the submitted content/songs. You hereby agree to defend, indemnify and hold harmless us, our subsidiaries, affiliates, successors, licensees, agents, attorneys and assigns, and their respective officers, directors, shareholders, contractors, members and employees from and against any and all liabilities, damages, awards, settlements, losses, claims, suits, proceedings, assertions and expenses, however characterized, including court costs, reasonable third-party legal fees and third-party costs of investigation arising from: (i) any claim by a third party that would constitute a breach of your representations, warranties, covenants or agreements under these terms; or (ii) arising from or related to the rights, permissions and authorizations granted by you under these Terms or the exercise thereof. TO THE MAXIMUM EXTENT PERMISSIBLE UNDER APPLICABLE LAWS, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN TORT, CONTRACT OR OTHERWISE, SHALL WE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, LIQUIDATED, EXEMPLARY, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND OR NATURE WHATSOEVER, RELATING TO THESE PODCAST TERMS OR THE TRANSACTIONS CONTEMPLATED HEREBY, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, AND REGARDLESS OF WHETHER BASED ON BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR STRICT LIABILITY, EVEN IF YOU HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES OR IF SUCH DAMAGES COULD HAVE BEEN REASONABLY FORESEEN.
- We reserve the right to alter or terminate the contest at our own discretion. Our decision is final with no appeal. All the information provided to us as part of the submission must be truthful. Provision of incorrect or inaccurate information will result in disqualification.
- We have the sole discretion to determine artiste eligibility, and reserve the right to change any of the eligibility requirements at any time. We reserve the right to amend these Terms at any time. Being shortlisted in the selection process does NOT guarantee that the artiste’s music would be published.
- These terms shall be governed by the laws of India.
- In the event of any dispute, the Courts of Mumbai shall have exclusive jurisdiction.
